			<content:encoded><![CDATA[<p>An elderly, retired miner will receive £70,000 <a title="personal injury claims" href="http://www.paulrooney.co.uk" target="_self">personal injury claims</a> compensation for an asbestos related condition which he contracted whilst at work.</p>
<p>Dennis Ball, 92, from Beeston suffers with the asbestos related condition mesothelioma; a cancer of the lining of the lung. The condition forced Mr Ball to move into a nursing home in order to receive treatment, last year.</p>
<p>As an employee of the Nottinghamshire based Sutton Colliery and Moor Green Colliery for twenty years, he was exposed to asbestos. This was admitted by the Department of Energy and Climate Change.</p>
<p>Mrs Justice Swift said the disease had “a devastating effect on his life”, and added: “Importantly, however, the onset of illness forced him to leave his home and thus to lose his independence.</p>
<p>“For a man with a fierce sense of independence and a fear of hospitals, this must have been a very difficult time for him”.</p>
<p>His injury lawyer Lesley Mynett said the case “paves the way for further elderly sufferers to receive settlements which reflect the pain and distress the disease causes, regardless of their age”.</p>
<p>“Mr Ball contracted this insidious disease through no fault of his own. All he did was work diligently.”</p>
<p>The claimant joined the navy at the age of fifteen. In 1964, he began working for British Coal and spent 19 years working at Moor Green; and was exposed to asbestos without any information or protection from the substance.</p>

			<content:encoded><![CDATA[<p>The supreme court of the UK has made a ruling which sets a precedent that could benefit thousands of asbestos sufferers claiming for compensation. The ruling by the high court placed insurance liability, for <a href="http://www.asbestosadvicehelpline.co.uk/">asbestos claims</a>, with the policy that was in place at the time that the client was exposed rather than when symptoms developed. This has allowed thousands of families to start pursuing claims that date back as far as the 1940s because the survivors and their families are still suffering the results of this criminal workplace negligence.</p>
<p><img class="alignleft" src="http://news.bbcimg.co.uk/media/images/49419000/jpg/_49419524_m1080634-spl.jpg" alt="" width="224" height="224" /></p>
<p>The ruling mirrored a similar law made in 2008 which placed responsibility with the insurance policy at the time of exposure. However, in 2010, this ruling was overturned by the appeal court and responsibility was place back onto the policy at the time that symptoms developed. This appeal has left many victims confused and uncertain when it comes to making claims because the law was repeatedly changing. Sufferers welcome this new ruling because it gives them new clarity and understanding as well as allowing them to pursue compensation from those responsible for their original exposure.</p>
<p>The ruling was made by a panel of 5 Supreme Court judges, who said that the disease can be said to be “sustained” at the time of exposure because this is when it was initiated or caused. In this way, the basic responsibility is no different to pursuing a claim about sustaining a workplace injury – the responsibility for which would rest with the insurers at the time that negligence caused the injury itself.</p>
<p>Lord Clarke, a judge on the panel, said: “The negligent exposure of an employee to asbestos during the policy period has a sufficient causal link with subsequently arising mesothelioma to trigger the insurer’s obligation”</p>
<p>The British Association of Insurers welcomes the ruling because of the new clarity it will give to their policy holders and to anyone pursuing compensation for asbestos related diseases. The legal battle caused by the appeal is apparently the result of a small group of ‘run off’ insurers meaning that they are no longer signing new policies. Reluctant to be responsible for these backdated asbestos claims, these companies pushed for the appeal that would see liability place back onto the insurers at the time of the illness.</p>
<p>According to <a href="http://www.bbc.co.uk/news/world-17535887">BBC news correspondent</a> Jane Peel: “The small group of insurers who brought this case argued that, they were not liable to pay compensation under employers’ liability insurance if the illness occurred outside the relevant policy period. The supreme court rejected this argument”</p>
<p>The new clarity within the law of asbestos claims could help to relieve some of the suffering of thousands of victims of asbestos related diseases and those who may develop symptoms in the future.</p>

After choosing an item of flat packed furniture from a shelf display, the man attempted to lift the box from the shelf, but the contents of the box, which was heavy, landed on the man’s foot causing serious injury.</p>
<p>He suffered a fracture and ruptured cartilage in his big toe; injuries which required hospital treatment. His injuries took time to heal and gave a great deal of pain to the victim who was also forced to wear a special protective footwear for a month. While he was able to return to normal activities upon recovery, it is predicted that he will likely develop an arthritic condition in the toe in later life and surgery will be necessary.</p>
<p>An accident claim was launched on the grounds that the injury was avoidable if the faulty box had not remained on display and after the supermarket failed to offer compensation, court proceedings were launched.</p>

<p>The “Red Tape Challenge” is a brand new website which acts as a place for businesses and employees to give their opinions as to how to improve the employment law that are currently in place.</p>
<p>Around 160 employment law regulations will come under review by the Business Department over the next three weeks, which fall under four separate categories; hiring staff, managing employees, letting people go, and compliance and enforcement.</p>
<p>Visitors to the Red Tape Challenge site can submit their opinions as to whether certain regulations are maintained, restructured, or even scrapped altogether.</p>
<p>Employment relations minister Edward Davey claims this new initiative will enable the Government to pinpoint employment law regulations that can be “simplified, merged and abolished” without having to “water down” employee rights.</p>
<p>Speaking about the Red Tape Challenge, Davey said: “We often hear from businesses that employment related regulation holds them back from growing their firms and employing more people.</p>
<p>“Whether it is the filling out of endless forms when you hire your first member of staff, the complexities of letting somebody go, or simply manage staff on a day-to-day basis, we want to review these regulations with the aim of giving business more confidence in employing people and creating more jobs.”</p>
